Terms & Conditions Agreement*

Terms & Conditions for Collection On Delivery (C.O.D): Payment is C.O.D. for all container services unless otherwise prearranged. Submission of this form does not constitute confirmation of service. Your service will be confirmed via email from Sidelifter, and scheduling will be done within 24 hours, excluding weekends. Payments other than C.O.D must be discussed and agreed upon by both parties prior to scheduling. Any dispute is subject to the jurisdiction of West Sacramento, Yolo County, California.

CUSTOMER PROPERTY DAMAGE WAIVER — PLEASE READ AND ACCEPT BY SUBMITTING/SIGNING BEFORE DELIVERY OF CONTAINER

I, the undersigned, hereby agree to hold harmless SIDELIFTER.COM, INC. for any personal injury to me, my employees, or any individual on my property, or any damage to structures on property, shrubs, bushes, trees, waterlines, electrical lines, lights and light connections, gas lines, railings, fences, driveways, curbs, walkways, ground and ground surfaces, or adjacent equipment, vehicles, or any machine while on this property for the purposes of delivering or picking up containers. Should I request that a driver attempt a questionable maneuver for the placement or pick up of a container, I agree to pay all expenses that may arise from such an attempt, including but not limited to a third party property damage and personal injuries, towing fees, auxiliary extricating charges, stand-by fees, hotel and meal charges, and equipment repair charges that may arise from said attempt. By submitting this form, I am in agreement with all statements herein. UPON SUBMISSION, THIS AGREEMENT WILL BE EXECUTED AND DELIVERED IN, AND SHALL BE INTERPRETED, CONSTRUED, ENFORCED, AND GOVERNED BY AND IN ACCORDANCE WITH THE LAWS OF THE STATE OF CALIFORNIA. THE COURTS OF CALIFORNIA SHALL BE THE EXCLUSIVE COURTS OF JURISDICTION AND VENUE FOR ANY LITIGATION, SPECIAL PROCEEDING, OR OTHER PROCEEDING BETWEEN THE PARTIES THAT MAY BE BROUGHT, OR ARISE OUT OF, IN CONNECTION WITH, OR BY REASON OF THIS AGREEMENT. EACH PARTY HEREBY CONSENTS TO THE JURISDICTION OF SUCH COURTS.
